Terms of Use
1. Purpose and Acceptance
These Terms of Use (the "Terms") govern access to the website www.originalrealestate.lu (the "Website") published by Original Real Estate sàrl-s ("ORE"), as well as the use of its content and services.
Merely browsing the Website constitutes full and unreserved acceptance of these Terms. A user who refuses all or part of these Terms must refrain from using the Website.
ORE reserves the right to amend the Terms at any time. The applicable version is the one in force at the time the Website is accessed.
2. Nature of the Information Published
2.1 Informational Purpose Only
Content published on the Website — including property fact sheets, brochures, indicative opinions of value, market data, articles and analyses — is provided for information purposes only. It does not constitute personalised professional advice, a binding offer to sell or let, nor a solicitation to invest.
2.2 Accuracy and Updates
ORE uses reasonable means to ensure the accuracy and regular updating of the information published. However, ORE does not guarantee the completeness, absolute accuracy or continuity of the content, which may change without notice based on market developments, current instructions and information provided by property owners.
2.3 Editorial Selection of Published Properties
The Website only features a selection of the properties and buildings handled by ORE. This selection reflects an editorial discretion exercised by ORE, based in particular on the quality and completeness of the available information, the availability of suitable visual materials, the agreement of the relevant owner and the commercial relevance at a given time.
The absence of a property from the Website does not mean that it does not exist in ORE's database, nor that it is not being marketed by ORE. Interested users are invited to contact ORE to be informed of opportunities not published online. ORE reserves the right at any time to add, modify or remove a property from the Website, without notice and without any obligation to give reasons.
3. Independence and Transparency
ORE undertakes to carry out its assignments with independence and integrity. Where ORE acts for more than one party in the same transaction, or where any relationship of interest may objectively affect a recommendation, the situation will be disclosed to the client concerned, in accordance with the ethical rules applicable to the real estate profession in Luxembourg. As a member of the Royal Institution of Chartered Surveyors (RICS), ORE is furthermore bound by the corresponding ethical principles, in particular regarding conflicts of interest.
4. Artificial Intelligence and Automated Tools
The Website may use artificial intelligence tools to generate, enrich or rank certain content (descriptions, searches, visualisations). These technologies evolve continuously: although ORE undertakes to regularly update the underlying data, it does not guarantee their completeness, absolute accuracy, nor the absence of synchronisation delays between its internal database and the display on the Website.
Certain properties may be under-represented or may not appear in search results, both for technical reasons (ranking rules, synchronisation delays) and for editorial reasons under the discretionary selection described in Article 2.3. In either case, the absence of a property may not be interpreted as an intention to exclude it, nor as an indication regarding its actual availability.
5. Intellectual Property
The Website as a whole — including its architecture, graphics, logo, texts, photographs, plans, brochures, databases and any other element — is protected by intellectual property law and remains the exclusive property of ORE or its licensors.
ORE grants the user a personal, non-exclusive, non-transferable and revocable licence, limited to consulting the Website and printing for strictly private use. The following are in particular prohibited without ORE's prior written consent:
- reproduction, redistribution or publication, in whole or in part, of the content;
- systematic extraction or re-use of all or part of the database (articles 72-A et seq. of the Luxembourg Act of 18 April 2001);
- the use of bots, scrapers, automated exploration tools or any form of bulk querying;
- circumventing, disabling or neutralising any technical protection measure;
- any commercial use of the content.
6. User Conduct
The user undertakes to access and use the Website in good faith. In particular, the user shall not:
- engage in any activity likely to disrupt, slow down or compromise the operation of the Website;
- attempt unauthorised access to restricted areas or to third-party personal data.
ORE reserves the right to suspend or block access, without notice, to any user in breach of these Terms, without prejudice to any legal recourse.
7. Links to Third-Party Websites
The Website may contain links to websites operated by third parties. ORE has no control over such websites and disclaims all liability regarding their content, their data protection policies or the consequences of consulting them.
8. Liability
ORE uses all reasonable means to ensure the availability and security of the Website. However, ORE shall not be held liable for:
- interruptions, unavailability or malfunctions affecting the Website;
- direct or indirect damages resulting from the use or inability to use the Website;
- consequences arising from the use of information of an indicative nature published on the Website.
ORE's liability may only be engaged in the event of gross negligence, wilful misconduct, or manifest breach of its contractual obligations within the scope of a formally documented engagement.
9. Personal Data
The processing of personal data collected through the Website is described in the Privacy Policy, which forms an integral part of these Terms.
10. Governing Law and Jurisdiction
These Terms are governed by Luxembourg law. Any dispute regarding their interpretation or performance shall fall within the exclusive jurisdiction of the courts of the judicial district of Luxembourg, without prejudice to the mandatory provisions applicable to consumers.
